Delhi MenCell: 15 साल से अलग Wife, फिर भी Divorce नहीं? Supreme Court ने Husband की बात क्यों मानी

“साथ रहना लगभग खत्म हो चुका था… फिर भी marriage legally खत्म क्यों नहीं हो रही थी?”

यह सवाल उन Delhi husbands और Delhi-NCR men के लिए बहुत real है जो वर्षों से matrimonial separation में जी रहे हैं।

2 June 2026 को Supreme Court ने Sonal Talpada v. Veerbhan Singh, 2026 INSC 620 में एक बेहद अलग matrimonial situation examine की।

Marriage 5 December 2007 को हुई थी। Wife एक Government Hospital में Gynaecologist थीं और husband भी Rajasthan State service में doctor थे।

लेकिन matrimonial home में दोनों मुश्किल से 2–3 महीने साथ रहे।

Husband ने 2009 में divorce petition file की, alleging cruelty.

Family Court ने initially divorce deny कर दिया।

फिर High Court ने husband के favour में divorce grant किया।

Matter Supreme Court पहुँचा।

और यहाँ एक important fact सामने आया:

लगभग 15 वर्षों से दोनों अलग रह रहे थे।

पूरे 18-year period में उनकी actual cohabitation केवल लगभग 2–3 महीने रही।

Husband का specific case यह भी था कि wife ने कई occasions पर sexual relations establish करने से इंकार किया। Supreme Court ने evidence में पाया कि short period of cohabitation के दौरान भी दोनों अलग rooms में सोते थे, और wife ने इस fact को deny नहीं किया।

Supreme Court ने कहा कि reasonable cause के बिना prolonged refusal of sexual intercourse can amount to mental cruelty and can be a ground for divorce under Section 13(1)(ia) HMA.

लेकिन कहानी सिर्फ “15 साल अलग” होने की नहीं थी।

Court ने देखा:

No child.
No successful reconciliation.
Mediation भी unsuccessful.
No meaningful effort to restore matrimonial life.
लगातार अलग-अलग lives.

Court ने यह भी explain किया कि बहुत लंबे समय तक complete separation और matrimonial interaction का खत्म हो जाना circumstances में mental cruelty और irretrievable breakdown की ओर संकेत कर सकता है।

अंततः Supreme Court ने Article 142 का इस्तेमाल करके marriage dissolve कर दी।

यह Delhi MenCell, Men Cell Delhi और Purush Aayog Delhi के लिए एक important search-intent issue है क्योंकि कई husbands का सवाल FIR या maintenance नहीं होता।

इसलिए Delhi matrimonial case में emotional allegations से ज्यादा important हो सकते हैं — actual cohabitation की chronology, communications, mediation records और Court proceedings।

एक marriage practically खत्म हो जाए लेकिन legally unresolved रहे, तो सालों की litigation दोनों sides के लिए भारी पड़ सकती है।

Men Cell Delhi: Advocate ने Court की बात ही बदल दी — “Order आपके favour में है” बोलकर Client को अंधेरे में रखा?

“Sir, आज Court में क्या हुआ?”

“कुछ नहीं हुआ. अगली date मिल गई है.”

Client ने भरोसा कर लिया।

कुछ दिन बाद किसी तरह Court order हाथ में आया।

और वहाँ लिखा था कुछ और।

जो Advocate ने बताया था, Court record में वैसा कुछ था ही नहीं।

अब सवाल सिर्फ यह नहीं है कि Advocate ने गलत information क्यों दी।

सवाल यह है:

अगर Client अपने ही Advocate की बात पर भरोसा नहीं कर सकता, तो वह अपने case को monitor कैसे करेगा?

Matrimonial और family disputes में यह problem और dangerous हो सकती है।

क्योंकि एक Client अक्सर Court में हर date पर खुद मौजूद नहीं होता। वह अपने Advocate से पूछता है:

“क्या हुआ?”

“Opposite party आई थी?”

“Judge ने क्या कहा?”

“कोई order हुआ?”

“मेरी application का क्या हुआ?”

“अगली date क्यों मिली?”

और जवाब मिलता है:

“सब ठीक है, tension मत लो.”

लेकिन कभी-कभी “सब ठीक है” और actual Court record में बहुत बड़ा difference हो सकता है।

Supreme Court ने एक मामले में ऐसी स्थिति पर गंभीर टिप्पणी की जहाँ litigant ने अपने counsel की बताई हुई बात पर भरोसा किया था। Court ने माना कि litigant परिस्थितियों में counsel की communication पर bona fide reliance कर सकता है और संबंधित advocate के conduct को professional misconduct के रूप में Bar Council के सामने भेजने का निर्देश दिया।

इसका मतलब यह नहीं कि Advocate की हर गलती automatically corruption या professional misconduct है।

Professional misconduct का आरोप evidence से establish होना चाहिए।

लेकिन अगर Client को बार-बार ऐसी information दी जा रही है जो Court order, order sheet या case record से materially अलग है, तो इसे ignore करना भी समझदारी नहीं है।

इसलिए Delhi में divorce lawyers, matrimonial advocates, family lawyers या किसी भी litigation Advocate के साथ case चलाते समय एक simple habit रखिए:

हर important hearing के बाद actual Court order देखिए।

Advocate से पूछिए:

आज क्या हुआ?

क्या कोई order pass हुआ?

क्या कोई statement record हुई?

अगली date किस purpose के लिए है?

मेरी application का status क्या है?

और जहाँ संभव हो, order की copy अपने पास रखिए।

क्योंकि “मेरे Advocate ने कहा था” और “Court record में क्या लिखा है” — दोनों हमेशा एक ही चीज नहीं होते।

अगर आपको लगता है कि आपका Advocate आपको लगातार Court proceedings की गलत, अधूरी या misleading information दे रहा है, तो केवल phone पर बहस करने के बजाय evidence बनाइए।

Hearing dates लिखिए।

अपने Advocate से महत्वपूर्ण explanations written form में मांगिए।

और अगर record और explanations के बीच बार-बार serious contradiction दिखाई दे रहा है, तो independent legal review लेने में देर मत कीजिए।

The High Court examined the situation differently. A pending criminal case is not a conviction. The Court also noted that the matrimonial allegations were still to be proved and directed the government to issue the appointment, subject to the eventual outcome of the criminal trial.

अब Delhi के husband के लिए असली बात यहाँ से शुरू होती है।
