“Case तो अभी prove भी नहीं हुआ… फिर मेरी job क्यों रोक दी गई?”
एक husband के लिए यह सिर्फ matrimonial problem नहीं रह जाती। अगर वह government service, senior corporate role, professional licence या किसी ऐसी position में है जहाँ background verification important है, तो wife की criminal complaint का stress घर से निकलकर career तक पहुँच सकता है।
एक Rajasthan High Court case में यही unusual situation सामने आई।
The husband had cleared a competitive government recruitment examination with a merit rank, but during the appointment/background-verification process it came to light that his wife had filed criminal proceedings against him, including allegations under Sections 498A, 406, 323 and 494 IPC. The authorities refused to appoint him, relying on the pending criminal case.
The High Court examined the situation differently. A pending criminal case is not a conviction. The Court also noted that the matrimonial allegations were still to be proved and directed the government to issue the appointment, subject to the eventual outcome of the criminal trial.
अब Delhi के husband के लिए असली बात यहाँ से शुरू होती है।
